The american One Direction have spoken to BBC`S newsbeat and said that they will not step back and let the UK One Direction have their name!
The five boys are suing the music mogul for $1 million (£630,000) in damages, and a share of the British group’s profits, claiming trademark infringement.
Sean from the band said:
‘He [Simon Cowell] is obviously a very smart man, but we are not intimidated,’
‘The law isn’t a popularity contest. Our name has been infringed.’
He also said that the band has received death threats and hate mail from the UK band’s fans over the drama 99 per cent from British followers of the band.
In court documents, filed on Monday in California Central District Court, the American band says it formed in 2009 - a year before Niall Horan, Zayn Malik, Liam Payne, Harry Styles and Louis Tomlinson had even met.
The U.S. group also say it beat their British counterparts to the U.S. Patent and Trademark Office, filing a trademark application before them.
